Over at BLT, Tony Mauro has this interesting report of a forthcoming New Yorker interview in which Justice Stevens says he hasn’t made up his mind yet whether to retire at the end of the Term.

      Toobin quoted Stevens as saying, “You can say I will retire within the next three years. I’m sure of that.”

      2010, 2011, or 2012. In other words, before the next presidential election, to avoid a repeat of the Brennan/Marshall/Carter situation.

      [SOTUs] are political occasions, where I don’t think our attendance is required.

      Yet to read Roberts rant, you’d think Obama gave an executive order mandating their attendance.

      Perhaps neither. If he serves three more years, he would pass William Douglas as the longest serving justice in history.

      Re: the latter, more like a statement of his perception that Obama’s second term isn’t a lock. If Stevens wants to be replaced by a Democrat, does it seem likely he’d retire if Obama was sure to lose, but otherwise roll the dice? Not to me.

      He’ll retire before the fall elections, is my guess, so that Obama has more votes to confirm his replacement. He’s already let Obama know this, and is just faking people out so that the opposition to his replacement will have less time to organize.

      ef: I think that is more likely a result of a fairly common, but incorrect, habit of referring to the “Democratic Party” as the “Democrat Party”

      Which Republicans started in order to poke the Democrats with a stick. It’s stupid, but that’s politics these days.

      Maybe, just maybe, he thinks America would be better off if he stuck it out long enough for someone other than Obama to name his replacement? January 21, 2013 is within three years…

      You know, sometime a few decades before your 90th birthday is probably time for you to give it up. Hanging on in hopes of beating the record of someone universally known to have stayed too long, is hardly an admirable goal.

      I know he has the constitutional prerogative to put it off as long as he wants, but we should think seriously over the next few decades whether there should be some constitutional revisions on judicial terms. These provisions were drafted when lifespans were much shorter, judges had to do more of their own work versus signing off on clerk-drafted product, and the judiciary played a less important role in civic life than in modern times.
