I usually enjoy Orin Kerr's posts. And I assume this link is supposed to be a joke.
But I can't help but wonder if this attack on Ted Kennedy would count as one of the personal attacks that folks like Randy Barnett (post a little higher on the page) and Ben Ginsberg (TV commentary) seem to worry so much about (of course, Mr. Ginsberg advised the Swift Boat Liars while working for the Bush Campaign last year, but never mind).
Maybe you might also point out that what Kennedy ACTUALLY has said is that Bush should nominate someone like O'Connor, etc.
And maybe you might point out that there has been no shortage of fire and brimstone from the religious right.
I hardly think that qualifies as an attack on Ted Kennedy. An attack on Ted Kennedy would be suggesting that the unnamed nominee wear a "Property of Chappaquidick Swimming Team" t-shirt to the confirmation hearings.
