Chief Justice Roberts and the 11-day Gap:
Michael Froomkin and Steve Vladeck have co-authored a very interesting post about whether and when the D.C. Circuit can issue opinions with John Roberts on the panel following his resignation from the D.C. Circuit. Ann Bartow's comment seems about right to me: "This is completely awesome pedantic weeniedom, and I mean that in the best possble way."

As a real live resident of downtown DC, all praise the beauty of pednatic weeniedom! The disenfranchised among us will take what we can get, and we're not ashamed of exploiting procedural technacalities. Rule of law, dude.

I'd like to see this issue taken to SCOTUS. Let them decide. But does Roberts have to recuse himself?
