They never describe the Ninth Circuit's liberal majority as "controversial."
But they describe Konzinski, who is fairly centrist (on civil-rights issues, he is one of the swing-judges on the Ninth Circuit) as "controversial."
I guess anyone who is NOT on the far left is deemed "controversial" by some in the media.
