Breaking the Logjam - Conference and Blog:

Today and tomorrow is the NYU/NYLS conference on Breaking the Logjam: An Environmental Law for the 21st Century. The conference organizers have also launched a blog to further the discussion of environmental reform started at the conference.

For my own part, I will be presenting my paper on reforming America's hazardous waste laws tomorrow morning.

Breaking the logjam has started with the push to provide endangered species protections to the polar bear because of US contributions to CO2. If approved the remedies would be horrendous.

I read yesterday that a group of scientists? is now evaluating all species of penguins with the aim of pushing for the same reason.

existing statutes must be restructured to match the true character of environmental problems and their underlying causes.

For a symposium that seeks to achieve this goal, it certainly is light on technical expertise. It never ceases to amaze me that attorneys who couldn't explain pH, know the difference between ppm and ppb, or don't know that groundwater contamination frequently ends up contaminating water bodies miles away, can claim to be experts in such a highly technical field.
