Steve:It's not clear to me that this was a victory. There was a settlement between the parties resulting in a stipulated decision; the Tax Court's order accordingly reads: "Pursuant to the agreement of the parties in this case." We are left to wonder whether Prof. Fleischer was, indeed, successful in retaining his entire deduction, or whether he gave up some consideration as part of the settlement.
