The newswires are reporting that President Bush will nominate Third Circuit Judge (and former head of the DOJ Criminal Division) Michael Chertoff to be the new head of the Department of Homeland Security. Assuming Chertoff will be confirmed — and that seems a pretty safe bet, as he has been confirmed by the Senate twice before in the last four years — it will be a big loss for the Third Circuit but a big gain for the Department of Homeland Security. Chertoff is the real deal, and was highly respected within DOJ and around Capitol Hill when he was the head of the Criminal Division.
