The gist of the complaint seems to be an argument that the federal constitution required the appointment of a person to represent Terri’s rights directly, and that the state procedures violated the Constitution by allowing the state trial judge to act as a “health-care surrogate.” I’m no expert in this area, but at first blush this doesn’t sound very persuasive to me.
