Last week the United States filed a petition for rehearing en banc in Warshak v. United States, the e-mail privacy case that I have blogged a lot about (and had several more posts planned on before other events intervened — I hope to finish up the series soon). As you might guess based on my previous blogging, I think the government’s petition for rehearing should be granted. Indeed, I will soon be filing an amicus brief to that effect on my own behalf. If all goes smoothly, I should be mailing out the brief later today. I’ll post a copy here after it’s out the door.
