The sentencing hearing in the Lori Drew prosecution is scheduled for May 18, now just five days away. In the last two days, both the prosecution and defense have filed supplemental sentencing briefs responding to the sentencing position of the other. As I have noted previously, Judge Wu has not yet ruled on the defense’s motions to dismiss, so the issues of whether violating the TOS is a crime and whether there was sufficient evidence that any such violation was intentional have not yet been decided.
