The Court apparently released just one case today, an 8-1 reversal in NRG Power Marketing v. Maine Public Utilities Commission, No. 08-674. Still no Citizens United opinion. The further delay reinforces my impression that the decision will be a “dog’s breakfast” of separate opinions.
As for timing, it seems likely the Court will release an opinion in Citizens United next Wednesday (Tuesday they’ll be releasing orders), or perhaps the following Monday (January 25), because otherwise, there are no other scheduled hand-down days before late February, which is cutting things awfully close to the primaries. Of course, the Court can always schedule new hand-down days, as it sometimes does in late June when it’s winding up the Term; that would be unusual, but this whole case, beginning with the special September argument sitting, has been unusual.
