This morning the Supreme Court upheld the constitutionality of the federal law barring “material support” to designated terrorist organizations, at least as applied to the type of support the plaintiffs sought to provide in this case. Chief Justice Roberts wrote for the Court in Holder v. Humanitarian Law Project, joined by the Court’s conservatives and Justice Stevens. Justice Breyer dissented, joined by Justices Ginsburg and Sotomayor. I’ll provide links to commentary on the decision later.
In other news of the dog-bites-man variety, the Court reversed an environmental decision of the U.S. Court of Appeals for the Ninth Circuit in Monsanto Co. v. Geertson Seed Farms, 7-1.
