I watched the C-span coverage of the Senate Judiciary Committee hearing on the constitutionality of the health care law, and I was impressed with the level of discussion and its seriousness, on the part of the Senators and the professors (mostly) who served as witnesses. It’s true I was at the gym and operating on 20% O2, but I thought it was a terrifically informative discussion. People were clear about their positions and respectful and willing to engage with positions other than their own.
It was a pleasure to see on the expert panel Our Very Own Conspirator Randy Barnett. Congratulations to him. It is a remarkable thing to see libertarianism coming into its own, so to speak, as a mainstream philosophy of law.
