Those who still care about quaint historical notions like federalism and enumerated powers might enjoy the podcast of my radio interview with Bob Zadek last week, “Repeal the 17th Amendment.” We discuss, among other issues, a certain Supreme Court case that has recently been somewhat in the news, whether that law would have been enacted if Senators were still elected by state legislatures, and the difference between democracy and a constitutional republic designed to protect liberty, frustrate special-interest faction, and limit self-seeking by governmental officials. I can even think of a Supreme Court Justice who might benefit from being reminded that federalism and enumerated powers was designed to create a system to protect individual liberty and limited government from political overreach, not to maximize democracy.
