I can’t believe I didn’t see this until now, but this morning the Supreme Court handed down Danforth v. Minnnesota, the very important habeas decision I blogged about at length back in November. To my surprise, based on the oral argument, the Court ruled for the defendant: The Court divided 7-2, with Justice Stevens writing for the majority and Chief Justice Roberts (joined by Justice Kennedy) in dissent. I think that was the right decision based on the briefs and my own research, but I’ll have to read the opinions before I can say more.
