For those who can’t get enough of Marshall v. Marshall, the Federalist Society posted a podcast discussion of the case last week. Participants include David Skeel, Troy MacKenzie, and me, with Judge (and bankruptcy expert) Edith H. Jones as the moderator. The discussion quickly moves to broader issues beyond the case itself to some of the larger issues involving the proper scope of jurisdiction of Article I v. Article III judges and the related issues of bankruptcy forum shopping. Judge Jones has some particularly interesting thoughts on these topics toward the end of the discussion, especially on the appointment process of Bankruptcy Judges (which is done by Court of Appeals Judges).
