Given JA’s post below about the NSA domestic surveillance program in light of Hamdan, it’s worth pointing out that DOJ is sticking to its guns. DOJ released a letter (.pdf) dated yesterday announcing its view that Hamdan has no impact on the legality of the NSA program.
