Here’s a question for the medical professionals in the VC audience. In his opinion earlier this week in Jackson v. Pollion, Judge Posner criticizes the magistrate judge and district judge for reaching the wrong conclusion about whether the plaintiff’s failure to receive his hypertension medications for three weeks could have a significant impact on the patient’s health. As I understand the legal standard, the issue is whether “the failure to treat a prisoner’s condition could result in further significant injury or the unnecessary and wanton infliction of pain.” So here’s the question for physicians or nurses out there: Do you agree with Posner’s diagnosis? The short opinion is available here, and the key discussion starts on the middle of page 4.
