Ressam does reverse a Ninth Circuit decision by Judge Rymer that considered itself bound as a matter of circuit precedent by an earlier Ninth Circuit case, United States v. Stewart, 779 F.2d 538 (9th Cir. 1985), written by then-Judge Anthony Kennedy.
